Can I keep my immigration status if I'm getting divorced?

Possibly! It depends on your legal status at the time of separation and divorce, and if you qualify for other immigration relief.

FAQ 02.

I signed the Form I-864 Affidavit of Support, what does this mean?

The I-864 is a legally binding contract with important obligations enforceable by the U.S. government or the beneficiary. It may also be enforceable during a divorce case in California.

FAQ 03.

My spouse abused me, will this affect my divorce or immigration case?

Abused spouses can qualify for special protections under U.S. immigration law and California state law. If you were a victim of domestic violence, you may qualify for a restraining order.

FAQ 04.

My spouse lives abroad, can I still get a divorce?

In California you can still get a divorce even if your spouse resides abroad. You may have to follow the process outlined by the Hague Convention.
